Unpaid Wages & Overtime

You deserve to be compensated for the hard work you do—ALL the hours that you work.

It is straightforward—hourly employees are to be paid for every hour they work. That’s the law—but employers sometimes violate it. For example, they require employees to perform some duties “off the clock,” such as working at home, putting on or removing safety equipment, working during lunch, and working before or after the “official” start of the workday. Other employers do not pay workers for training and/or travel time, or do not reimburse expenses. Hourly employees are entitled to overtime pay for time worked in excess of 40 hours during a work-week.

Employees who are paid a salary may be entitled to overtime wages if the employer inappropriately treats an employee as “exempt” from the federal Fair Labor Standards Act (FLSA) and Pennsylvania’s Wage Payment and Collection Law (WPCL).

If your employer does not pay you for all the hours you work, you may be entitled to additional wages, liquidated damages, and payment of attorneys’ fees. If you believe that you may have been categorized as “exempt” when you should be paid overtime, our attorneys can evaluate your situation.
